With the uptick in COVID-19 cases due to the Delta variant, we want to address safety protocols for upcoming VAMA events. Safety protocols will be determined based on the rate of transmission at the time of the event in the city/county where the event will be held. Transmission rates can be found here:

Additionally, all in-person event attendees will be required to sign VAMA's waiver certifying that they are in good health and have not been in contact with anyone with a known or suspected case of COVID-19 in the last 14 days.

VAMA has received follow-up from the Virginia Department of Health that confirms that property management, leasing, maintenance and other on-site personnel will be included in Phase 1c of vaccine distribution in Virginia. This is owing to our inclusion under the ‘housing construction’ category of employees in Phase 1c. You can learn more about the phases and Virginia’s response as a whole here.

WHICH HEALTH DEPARTMENT DO YOU CALL? Vaccinations are administered by Health Departments in each locality based upon the source of an individual's eligibility. Persons that qualify based upon individual medical conditions will register and have their vaccine administered by the Health Department office where they live. However, if eligibility is based upon employment, then registration must be handled through the Health Department office in the jurisdiction where they work.

QUALIFYING BASED UPON PERSONAL HEALTH CONDITIONS - VAMA members may be surprised to learn that some common medical conditions may qualify some persons age 16-64 to receive a vaccine in Group 1b. For example, current or former smokers and/or pregnant or nursing mothers.

The Families First Coronavirus Response Act (FFCRA or Act) requires certain employers to provide employees with paid sick leave or expanded family and medical leave for specified reasons related to COVID-19. The Department of Labor’s Wage and Hour Division (WHD) administers and enforces the new law’s paid leave requirements. These provisions will apply from the effective date through December 31, 2020. The Virginia Department of Labor and Industry recently rolled out new emergency regulations, as directed by Governor Northam, that create additional requirements for Virginia employers related to workplace safety due to COVID-19.  Please click here to review an extensive library of government documents on these new regulations.

Biggest differences between phase 2 and phase 3 for Virginia.

• Capacity limits on restaurants and nonessential retail businesses will be lifted, but tables will still have to be six feet apart and social distancing needs to be followed.
  

• The maximum size of group gatherings will be increased from 50 to 250 people.

• Zoos, museums can open at 50%

• Outdoor entertainment such as water parks and amusement parks limited to 1,000 people

• Gym and fitness centers can go up to 75% of capacity

• Pools at 75% capacity

• Grooming services will be fully open — physical distancing will still be required.

• Overnight summer camps will still be closed

Phase Two expected to begin Friday June 5, Northern Virginia and Richmond to remain in Phase One

Phase Two of Virginia's reopening plan was announced this week.  For the full list of guidelines CLICK HERE.

Highlights:

Executive Order 65, signed by Northam on Tuesday, establishes the guidelines for Phase 2, which call for the following:

• The original 'Stay at Home' order is a 'Safer at Home' strategy, calling for people to continue social distancing, teleworking, and requiring individuals to wear face coverings in indoor public settings, in accordance with the executive order signed last week.


• Virginia's 10-person limit on gatherings will be expanded to a 50-person limit, and all businesses still need to adhere to physical distancing guidelines, frequently clean and sanitize high contact surfaces, and continue enhanced workplace safety measures.
  

Specific business changes are as follows:

• Restaurant and beverage establishments may offer indoor dining at 50 percent occupancy
• Fitness centers may open indoor areas at 30 percent occupancy with fitness equipment separated by at least 10 feet
• Certain recreation and entertainment venues without shared equipment may open with restrictions. These venues include museums, zoos, aquariums, botanical gardens, and outdoor concert, sporting, and performing arts venues.
• Swimming pools can open up to both indoor and outdoor exercise (like lap swimming), diving, and swim instruction. (Splash pads, saunas, hot tubs, etc. must stay closed

The current guidelines for religious services, non-essential retail, and personal grooming services will largely remain the same in Phase Two, including 50% capacity in both retail and houses of worship, and health restrictions for personal grooming services.

Overnight summer camps, most indoor entertainment venues, amusement parks, fairs, and carnivals will remain closed in Phase Two.

Face coverings required in public settings starting Friday, May 29th

Press release highlights:

"A face covering includes anything that covers your nose and mouth, such as a mask, scarf, or bandana. Medical-grade masks and personal protective equipment should be reserved for health care professionals. Under the Governor’s executive order, any person age ten and older must wear a mask or face covering at all times while entering, exiting, traveling through, and spending time in the following public settings:

• Personal care and grooming businesses
• Essential and non-essential brick and mortar retail including grocery stores and pharmacies
• Food and beverage establishments
• Entertainment or public amusement establishments when permitted to open
• Train stations, bus stations, and on intrastate public transportation, including in waiting or congregating areas
• State and local government buildings and areas where the public accesses services
• Any indoor space shared by groups of people who may congregate within six feet of one another or who are in close proximity to each other for more than ten minutes

Exemptions to these guidelines include while eating and drinking at a food and beverage establishment; individuals who are exercising; children under the age of two; a person seeking to communicate with a hearing-impaired person, for which the mouth needs to be visible; and anyone with a health condition that keeps them from wearing a face covering. Children over the age of two are strongly encouraged to wear a face covering to the extent possible."

Friday, May 29th Richmond City and Northern Virginia will join the rest of Virginia in entering into phase 1 of reopening.  Phase 1 will last at least 2 weeks but could be several weeks depending on health data on new cases.  The reopening will be slow and deliberate. 

The Governor’s Forward Virginia plan has 3 phases.  Below are some of the general and specific industry rules of Phase 1.  You will need to review the full guidelines HERE or HERE to ensure you comply:   

PHASE 1 – GENERAL GUIDELINES

• “Safer at Home” will be the new theme especially for vulnerable populations
• 10-person limit for all gatherings
• Social distancing when in public
• Continue teleworking for all employees who can
• Face coverings when in public
• Enhanced Cleaning and Disinfection Best Practices such as practicing routine cleaning and disinfection of high contact areas and hard surfaces
• Enhanced Workplace Safety Best Practices such as screening of employees; Instruct employees who are sick to stay at home and not report to work; Post signage in the common languages of the employees telling them not to come to work when sick; Develop or adopt flexible sick leave policies

PHASE 1 – SPECIFIC GUIDELINES

• Non-Essential Retail – May open with 50% indoor capacity; Delivery and pick up continues; Employees wear masks
• Restaurants/Breweries – NO indoor seating; Takeout and delivery continues; Outdoor seating allowed at 50% capacity with required 6 feet social distancing between diners and from sidewalk or any public area; Required to use disposable menus; Employees must wear masks
• Personal Grooming – Appointment only with strict social distancing requirements (50% capacity); Client and worker must wear face masks; Limits what services that can be done with mask; No lip waxing or beard trims.
• Childcare – open for working families (same as before)
• Gyms – NO indoor use; Limited outdoor exercise to 10 participants with 10 feet of distance and sharing guidelines for equipment
• Entertainment and amusement (bowling alleys, theatres, etc.) – Staying closed
• Beaches – Only for exercise and fishing
• Private campgrounds – Open with distance between campsites; No gatherings of 10 or more
• State Parks – Day use only; No gatherings of 10 or more; Overnight in phases
• Overnight summer camps – Closed
• Places of worship – 50% indoor capacity; Drive-in and Online still encouraged

Enforcement:

As with previous Executive Orders, these new guidelines will be enforced by local law enforcement who are able to write citations for violations.

HB340 was introduced this year by Delegate Marcia Price to create a stay of evictions and foreclosures in situations where an individual’s ability to meet their financial obligations for rent or for mortgage were adversely impacted by closure of the United States Government. As this legislation was not signed by the Governor prior to the start of the COVID-19 pandemic, the Governor’s office returned to the legislature an amendment to HB340 extending HB340’s coverage to individuals whose ability to meet their financial obligations for rent and mortgage were adversely “affected by” Virginia’s declaration of a COVID-19 State of Emergency. This document will seek to provide an analysis of various elements of the legislation and answer questions related to the applicability of HB340 and COVID-19 with regard unlawful detainer actions.

If you are a worker who has been totally or partially separated from your job due to Coronavirus, please note that no claim for unemployment insurance may be filed or processed until an actual lay off from employment has occurred, or until there has been an actual reduction in hours. When filing your claim for unemployment benefits, please be sure to check the reason for separation as Lack of Work/Lay off. In response to the COVID-19 global pandemic and the financial hardships some residents are experiencing, as a courtesy, the National Apartment Association (NAA) has released the following two forms for your voluntary use:

1. Notice of Temporary Waiver of Late Fees
   Allows operators to waive late fees incurred by residents who, as a result of COVID-19, are experiencing loss of wages, unemployment or unexpected medical expenses. 
   

2. Payment Plan Agreement (COVID-19 Pandemic)
   Allows a resident who, as a result of COVID-19, is experiencing loss of wages, unemployment or unexpected medical expenses to pay rent and other sums at a later date.

In an effort to keep renters in their homes during the global pandemic, the FHFA has announced that Fannie Mae and Freddie Mac will be offering mortgage forbearance to multifamily property owners, with the condition that they suspend evictions for all renters unable to pay due to coronavirus. Dear NAA Members/Affiliates,

As you may have seen, California Gov. Gavin Newsom signed Executive Order N-33-20 mandating all individuals living in the State of California to stay home or at their place of residence to protect public health, exempting certain essential services. This is one example of a policy that could be adopted in other states as well.

The California State Public Health Officer and Director of the California Department of Public Health subsequently clarified that all individuals living in the State of California are to stay home or at their place of residence, except as needed to maintain continuity of operation of the federal critical infrastructure sectors, critical government services, schools, childcare and construction, including housing construction.

The reference to “critical infrastructure sectors” by California officials refers to the U.S. Department of Homeland Security, Cybersecurity and Infrastructure Security Agency’s (CISA) Guidance on the Essential Critical Infrastructure Workforce. The Guidance was issued intending “to support State, Local and industry partners in identifying the critical infrastructure sectors and the essential workers needed to maintain the services and functions Americans depend on daily and need to be able to operate resiliently during the COVID-19 pandemic response.”

Per CISA, “Real Estate” (e.g., office and apartment buildings, condominiums, mixed use facilities, self-storage) is a subsector of the “Commercial Facilities Sector” and therefore exempt under the California Governor’s order as an essential critical infrastructure sector. Thus, rental industry professionals are permitted and have a “special duty” to maintain continuity of operations. However, keep in mind the CISA guidance is not a federally mandated standard and, therefore, other state and local governments may decide differently if they enact their own orders.

Regardless of whether you operate in California, we are writing to encourage you to develop a written statement that outlines your company’s business operations that are “essential” and must continue to be performed in person, should your state or local government issue a similar mandate in light of COVID-19. If a state or local mandate is issued, keep in mind the specific parameters as identified in the order and adjust your operations accordingly.

We encourage our state and local apartment association partners to work with public officials to ensure that property management and construction of housing are explicitly exempt from any “shelter in place” requirements to ensure the viability of our industry.

For industry professionals, how do I know if what I do is an essential service? The most logical and sound argument for “essential” status is the work of maintenance personnel to maintain healthy living standards in apartment communities, especially as it relates to habitability concerns under landlord and tenant law. For example, if a water or sewage problem were allowed to persist, there would be health risks to the entire population of residents beyond COVID-19.

In a recently published article in the National Law Review, Squire Patton Boggs advises companies:

“Take local advice on what is required according to local law. Across most countries, employees are encouraged/required to work from home if they can. This may cover the whole of your organization, or only parts of it. Subject to requirements of local law, we recommend that you produce a description of the activities your organization or company undertakes site by site, and how those activities contribute to essential services, and ensure that every employee has a copy. Where governments – as, for example, in France – require employers to certify that certain activities of employees cannot be performed remotely, we would recommend, if possible, to include the description of the company’s activities and how they contribute to essential services within the certificate. It is also important as an employer that you are conscious of the duty of care you have for your employees.”

Again, remember every jurisdiction is different. We advise you to pay close attention to the definition of essential services as you craft your policies and procedures during this unprecedented time.

For example, New York Governor Cuomo signed Executive Order 202.7, which mandates, effective March 21, 2020 at 8 p.m. and until further notice, all businesses and not-for-profit entities in the state shall utilize, to the maximum extent possible, any telecommuting or work from home procedures that they can safely utilize. Each employer shall reduce the in-person workforce at any work locations by 75 percent no later than March 21 at 8 p.m.

By the New York state standard, any essential business or entity providing essential services or functions shall not be subject to the in-person restrictions, including vendors of essential services necessary to maintain the safety, sanitation and essential operations of residences or other essential businesses.

Additionally, if you fall under a “Shelter in Place” order, we advise you take the following precautions:

• Limit onsite employees, maintain limited staff to ensure continuity of basic operations (service request management, rent collection and payroll, etc.).
• Where possible, limit in-person transactions between staff and residents. Consider implementing digital payment and maintenance requests or offer secure drop boxes. Note: Please review applicable state laws, which may prohibit landlords from mandating that residents pay rent online.
• Suspend all non-essential maintenance and repairs. Service requests should be categorized between essential (HVAC, hot water, plumbing, etc.) and non-urgent (upgrades, cosmetic repairs, etc.).
• Share staffing updates with residents and ensure emergency contact information is available. When possible, use multiple communication platforms such as email, community bulletin boards and notices to individual units.
• Contact vendors to determine availability for emergency maintenance needs. Ensure alternative arrangements are available.
• Continue move-out walk-through inspections when requested by residents, per legal requirements. However, follow appropriate social distancing protocols. Ensure the residents desire inspections in the current environment and, if the request is withdrawn, get it in writing.
• Consider providing virtual and low-contact showings to prospective residents. These could include virtual tours or allowing a prospect to enter and tour a unit on their own. Be sure to disinfect high-touch surfaces between showings (including door knobs, light switches, etc.).

In the latest update from the National Apartment Association, HUD is encouraging public housing authorities and rental housing providers who serve rent assisted residents to prevent the displacement of families through eviction. See the full report from NAA's President & CEO, Bob Pinnegar, below. 

Dear NAA members,

News related to COVID-19 is rapidly evolving. As an update to my previous email, the U.S. Department of Housing and Urban Development (HUD) confirmed that Secretary Ben Carson has authorized the Federal Housing Administration (FHA) to implement an immediate foreclosure and eviction moratorium for single-family homeowners with FHA-insured mortgages for the next 60 days. This announcement falls in line with the Federal Housing Finance Agency’s (FHFA) directive to Fannie Mae and Freddie Mac (the Enterprises) to suspend foreclosures and evictions for at least 60 days for homeowners with an Enterprise-backed single-family mortgage. 

In light of these extraordinary circumstances, HUD encourages public housing authorities (PHAs) and rental housing providers who serve rent assisted (Housing Choice Voucher (including Project-Based Voucher (PBV)), public housing and Indian Housing Block Grant (IHBG)) residents to prevent the displacement of families through eviction. Some PHAs have gone so far as to issue eviction moratoriums for housing that falls under their jurisdiction.

Bear in mind that states and localities continue to push their own eviction moratoriums, applicable to all privately-owned housing. Nationally, at least 35 jurisdictions announced eviction moratoriums in light of the spread of COVID-19 with more considering legislation or mandate by judicial action or law enforcement. We have developed a research report to help you navigate this patchwork of mandates, including information on eviction, rent increase restrictions, late fees and shelter-in-place orders.

A judicial emergency has been declared in all district and circuit courts of the Commonwealth of Virginia. The order is in effect until Monday, April 6th, and essentially suspends non-essential, non-emergency court proceedings. This means all non-emergency evictions are being halted.
