<title>VAMA&apos;s COVID Safety Protocols Updated 9/3/21</title>

<p style="font-size: 12pt; font-family: Raleway;"><span style="font-family: Raleway;">With the uptick in COVID-19 cases due to the Delta variant, we want to address safety protocols for upcoming VAMA events. Safety protocols will be determined based on the rate of transmission at the time of the event in the city/county where the event will be held. <p style="font-size: 12pt; font-family: Raleway;"><span style="font-family: Raleway;"></span><span style="font-size: 12pt; font-family: Raleway;">Additionally, all in-person event attendees will be required to sign VAMA's waiver&nbsp;</span><span style="font-size: 12pt;">certifying that they are in good health and have not been in contact with anyone with a known or suspected case of COVID-19 in the last 14 days.<br /></span></p>
    <div><span style="font-size: 16px;"><span style="font-family: Raleway; font-size: 16px;"><b>For event locations with High Community Transmission Rates as of the event date:</b></span><br /></span></div>
    <div style="box-sizing: border-box;"><span style="font-size: 16px;">
        VAMA is asking only individuals who have received a COVID-19 vaccination in the past 12 months, a COVID-19 Booster or can furnish a negative COVID test result within 48 hours of the event to attend in person. Attendees are asked to wear masks/face coverings
        at the event except when they are actively eating or drinking. When possible VAMA will make reasonable accommodations for individuals who are not vaccinated and wish to attend the event by offering the option of attending the event in a virtual
        capacity. <br />
        <br /><b>
For event locations with Substantial Community Transmission Rates as of the event date:</b><br /> VAMA is asking only individuals who have received a COVID-19 vaccination in the past 12 months, a COVID-19 Booster or can furnish a negative COVID test result
        within 48 hours of the event to attend in person. Masks/cloth face coverings are not required for those individuals who are vaccinated. When possible VAMA will make reasonable accommodations for individuals who are not vaccinated and wish to attend
        the event by offering the option of attending the event in a virtual capacity. <br />
        <br /><b>
For event locations with Moderate Community Transmission Rates as of the event date:</b><br /> Event attendance will be open to both vaccinated and non-vaccinated individuals. Attendees who have received a COVID-19 vaccination or COVID-19 Booster in the
        past 12 months are not required to wear masks/cloth face coverings. Unvaccinated attendees will be required to wear masks during the event except when they are actively eating or drinking. VAMA will continue to offer the option of attending the
        event in a virtual capacity when possible. (Plastic face shields are not an acceptable alternative to masks/cloth face coverings.)<br />
        <br /><b>
For event locations with Low Community Transmission Rates as of the event date:</b><br /> Vaccinated and Unvaccinated individuals are permitted to attend in person. Mask/cloth face coverings will not be required. VAMA will continue to offer the option
        of attending the event in a virtual capacity when possible.</span></div><div style="box-sizing: border-box;"><span style="font-size: 16px;">&nbsp;</span></div><div style="box-sizing: border-box;"><span style="font-size: 16px;"></span><span style="font-size: 12pt; font-family: Raleway;">Our priority remains the safety of our attendees, presenters, staff and venue personnel. <p>Highlights:</p>
<p style="color: #333333; margin: 0px 0px 10px;">Executive Order 65, signed by Northam on Tuesday, establishes the guidelines for Phase 2, which call for the following:<br />

    <li>The original 'Stay at Home' order is a 'Safer at Home' strategy, calling for people to continue social distancing, teleworking, and requiring individuals to wear face coverings in indoor public settings, in accordance with the executive order signed last week.</li>

    <li>Certain recreation and entertainment venues without shared equipment may open with restrictions. These venues include museums, zoos, aquariums, botanical gardens, and outdoor concert, sporting, and performing arts venues.</li>
    <li>Swimming pools can open up to both indoor and outdoor exercise (like lap swimming), diving, and swim instruction. (Splash pads, saunas, hot tubs, etc. must stay closed</li>

<p style="color: #333333; margin: 0px 0px 10px;">The current guidelines for religious services, non-essential retail, and personal grooming services will largely remain the same in Phase Two, including 50% capacity in both retail and houses of worship, and health restrictions for personal grooming services.</p>

Medical-grade masks and personal protective equipment should be reserved for health care professionals. Under the Governor’s executive order, any person age ten and older must wear a mask or face covering at all times while entering, exiting, traveling through, and spending time in the following public settings:</p>
<ul style="color: #333333; margin-top: 0px; margin-bottom: 10px;">
    <li>Personal care and grooming businesses</li>
    <li>Essential and non-essential brick and mortar retail including grocery stores and pharmacies</li>
    <li>Food and beverage establishments</li>

    <li>Train stations, bus stations, and on intrastate public transportation, including in waiting or congregating areas</li>

<title>VA&apos;s Phase One Reopening Guidelines</title>

<p class="p1" style="margin: 0px;">HB340 was introduced this year by Delegate Marcia Price to create a stay of evictions and foreclosures in situations where an individual’s ability to meet their financial obligations for rent or for mortgage were adversely impacted by closure of the United States Government. As this legislation was not signed by the Governor prior to the start of the COVID-19 pandemic, the Governor’s office returned to the legislature an amendment to HB340 extending HB340’s coverage to individuals whose ability to meet their financial obligations for rent and mortgage were adversely “affected by” Virginia’s declaration of a COVID-19 State of Emergency. This document will seek to provide an analysis of various elements of the legislation and answer questions related to the applicability of HB340 and COVID-19 with regard unlawful detainer actions.</p>

<title>NAA Guidance on Shelter-In-Place Orders</title>

<p style="margin: 0in 0in 0.0001pt;"><span>Dear NAA Members/Affiliates,</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>As you may have seen, California Gov. Gavin Newsom signed <a href="https://covid19.ca.gov/img/Executive-Order-N-33-20.pdf">Executive Order N-33-20</a> mandating all individuals living in the State of California to stay home or at their place of residence to protect public health, exempting certain essential services. This is one example of a policy that could be adopted in other states as well.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>The California State Public Health Officer and Director of the California Department of Public Health subsequently clarified that all individuals living in the State of California are to stay home or at their place of residence, except as needed to maintain continuity of operation of the federal <a href="https://www.cisa.gov/identifying-critical-infrastructure-during-covid-19">critical infrastructure sectors</a>, critical government services, schools, childcare and construction, <span style="text-decoration: underline;">including housing construction</span>.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>The reference to “critical infrastructure sectors” by California officials refers to the U.S. Department of Homeland Security, Cybersecurity and Infrastructure Security Agency’s (CISA) <a href="https://www.cisa.gov/sites/default/files/publications/CISA-Guidance-on-Essential-Critical-Infrastructure-Workers-1-20-508c.pdf">Guidance on the Essential Critical Infrastructure Workforce</a>. The Guidance was issued intending “to support State, Local and industry partners in identifying the critical infrastructure sectors and the essential workers needed to maintain the services and functions Americans depend on daily and need to be able to operate resiliently during the COVID-19 pandemic response.”</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>Per CISA, “Real Estate” (e.g., office and apartment buildings, condominiums, mixed use facilities, self-storage) is a subsector of the “Commercial Facilities Sector” and therefore exempt under the California Governor’s order as an essential critical infrastructure sector. Thus, rental industry professionals are permitted and have a “special duty” to maintain continuity of operations. However, keep in mind the CISA guidance is not a federally mandated standard and, therefore, other state and local governments may decide differently if they enact their own orders.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span><strong>Regardless of whether you operate in California, we are writing to encourage you to develop a written statement that outlines your company’s business operations that are “essential” and must continue to be performed in person, should your state or local government issue a similar mandate in light of COVID-19. If a state or local mandate is issued, keep in mind the specific parameters as identified in the order and adjust your operations accordingly.</strong></span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span><strong>We encourage our state and local apartment association partners to work with public officials to ensure that property management and construction of housing are explicitly exempt from any “shelter in place” requirements to ensure the viability of our industry.</strong></span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span><strong>For industry professionals, how do I know if what I do is an essential service?&nbsp;</strong>The most logical and sound argument for “essential” status is the work of maintenance personnel to maintain healthy living standards in apartment communities, especially as it relates to habitability concerns under landlord and tenant law. For example, if a water or sewage problem were allowed to persist, there would be health risks to the entire population of residents beyond COVID-19.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>In a recently published <a href="https://www.natlawreview.com/article/how-do-i-know-if-what-i-do-essential-service">article</a> in the National Law Review, Squire Patton Boggs advises companies:</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span><em>“Take local advice on what is required according to local law. Across most countries, employees are encouraged/required to work from home if they can. This may cover the whole of your organization, or only parts of it. Subject to requirements of local law, we recommend that you produce a description of the activities your organization or company undertakes site by site, and how those activities contribute to essential services, and ensure that every employee has a copy. Where governments – as, for example, in France – require employers to certify that certain activities of employees cannot be performed remotely, we would recommend, if possible, to include the description of the company’s activities and how they contribute to essential services within the certificate. It is also important as an employer that you are conscious of the duty of care you have for your employees.”</em></span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>Again, remember every jurisdiction is different. We advise you to pay close attention to the definition of essential services as you craft your policies and procedures during this unprecedented time.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>For example, New York Governor Cuomo signed <a href="https://www.governor.ny.gov/news/no-2027-continuing-temporary-suspension-and-modification-laws-relating-disaster-emergency">Executive Order 202.7</a>, which mandates, effective March 21, 2020 at 8 p.m. and until further notice, all businesses and not-for-profit entities in the state shall utilize, to the maximum extent possible, any telecommuting or work from home procedures that they can safely utilize. Each employer shall reduce the in-person workforce at any work locations by 75 percent no later than March 21 at 8 p.m.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>By the New York state <a href="https://www.governor.ny.gov/news/no-2026-continuing-temporary-suspension-and-modification-laws-relating-disaster-emergency">standard</a>, any essential business or entity providing essential services or functions shall not be subject to the in-person restrictions, including <strong>vendors of essential services necessary to maintain the safety, sanitation and essential operations of residences or other essential businesses.</strong></span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>Additionally, if you fall under a “Shelter in Place” order, we advise you take the following precautions:</span></p>
<ul>
    <li style="margin: 0in 0in 0.0001pt;"><span>Limit onsite employees, maintain limited staff to ensure continuity of basic operations (service request management, rent collection and payroll, etc.).</span></li>
    <li style="margin: 0in 0in 0.0001pt;"><span>Where possible, limit in-person transactions between staff and residents. Consider implementing digital payment and maintenance requests or offer secure drop boxes. <span style="text-decoration: underline;">Note: Please review applicable state laws, which may prohibit landlords from mandating that residents pay rent online.</span></span></li>
    <li style="margin: 0in 0in 0.0001pt;"><span>Suspend all non-essential maintenance and repairs. Service requests should be categorized between essential (HVAC, hot water, plumbing, etc.) and non-urgent (upgrades, cosmetic repairs, etc.).</span></li>
    <li style="margin: 0in 0in 0.0001pt;"><span>Share staffing updates with residents and ensure emergency contact information is available. When possible, use multiple communication platforms such as email, community bulletin boards and notices to individual units.</span></li>
    <li style="margin: 0in 0in 0.0001pt;"><span>Contact vendors to determine availability for emergency maintenance needs. Ensure alternative arrangements are available.</span></li>
    <li style="margin: 0in 0in 0.0001pt;"><span>Continue move-out walk-through inspections when requested by residents, per legal requirements. However, follow appropriate social distancing protocols. Ensure the residents desire inspections in the current environment and, if the request is withdrawn, get it in writing.</span></li>
    <li style="margin: 0in 0in 0.0001pt;"><span>Consider providing virtual and low-contact showings to prospective residents. These could include virtual tours or allowing a prospect to enter and tour a unit on their own. Be sure to disinfect high-touch surfaces between showings (including door knobs, light switches, etc.).</span></li>

Some PHAs have gone so far as to issue eviction moratoriums for housing that falls under their jurisdiction.</span><br style="color: #6f6f6f;" />

<span style="color: #6f6f6f;">Bear in mind that states and localities continue to push their own eviction moratoriums, applicable to all privately-owned housing. Nationally, at least 35 jurisdictions announced eviction moratoriums in light of the spread of COVID-19 with more considering legislation or mandate by judicial action or law enforcement. <p><span>A judicial emergency has been declared in all district and circuit courts of the Commonwealth of Virginia. The order is in effect until Monday, April 6th, and essentially suspends non-essential, non-emergency court proceedings.
